Welcome to Drawbie ("the App"). These Terms and Conditions ("Terms") govern your access to and use of the Drawbie mobile application. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1.1 Agreement to Terms

By using Drawbie, you acknowledge that you have read, understood, and agree to be bound by these Terms and any future modifications.

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

2. Description of Service

2.1 What Drawbie Offers

Drawbie is a creative drawing and coloring application designed for children and creative users. The App provides:

• Drawing tools for creating original artwork
• Pre-made coloring templates
• Personal gallery for saving and viewing artwork
• Discovery features to view artwork created by other users
• Local data storage on your device

2.2 Local Storage

All user data, including drawings, colorings, and account information, is stored locally on your device. We do not currently operate backend servers or cloud storage for user content.

2.3 No Guarantees

While we strive to provide a reliable and enjoyable experience, we do not guarantee that the App will be uninterrupted, error-free, or free from viruses or other harmful components.

3. User Accounts

3.1 Account Creation

To access certain features of the App, you may be required to create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account

3.2 Account Responsibility

You are responsible for all activities that occur under your account. You agree to use the App only for lawful purposes and in accordance with these Terms.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

4. User-Generated Content

4.1 Your Content

You retain ownership of all drawings, colorings, and other content you create using the App ("User Content"). By creating and saving content in the App, you grant us a non-exclusive, royalty-free license to display your content within the App's discovery features.

4.2 Content Standards

You agree that all User Content you create will:

• Not contain inappropriate, offensive, or harmful content
• Not infringe upon the intellectual property rights of others
• Not contain personal information of minors (names, addresses, phone numbers, etc.)
• Be appropriate for viewing by children and families
• Comply with all applicable laws and regulations

4.3 Content Monitoring

While we do not actively monitor all User Content, we reserve the right to review, remove, or disable access to any content that violates these Terms or that we deem inappropriate.

4.4 Reporting Inappropriate Content

If you encounter content that violates these Terms, please contact us immediately so we can take appropriate action.

5. Intellectual Property Rights

5.1 App Ownership

The App, including all source code, features, functionality, designs, graphics, interfaces, and coloring templates, is owned by us and is protected by international copyright, trademark, and other intellectual property laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

5.3 Restrictions

You may not:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App for commercial purposes without our written permission
• Distribute, sublicense, or transfer the App to third parties

5.4 Templates and Assets

All coloring templates, graphics, and visual assets provided in the App remain our intellectual property. You may use them to create artwork within the App but may not extract or redistribute them outside of the App.

6. Privacy and Data Collection

6.1 Privacy Policy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Please review our Privacy Policy to understand our practices.

6.2 Local Data Storage

Your drawings, colorings, account information, and preferences are stored locally on your device using standard iOS storage mechanisms. This data is not transmitted to external servers.

6.3 Data Security

While we implement reasonable security measures to protect your locally stored data, we cannot guarantee absolute security. You are responsible for maintaining the security of your device.

7. Children's Privacy

7.1 COPPA Compliance

We are committed to protecting the privacy of children. The App is designed to be compliant with the Children's Online Privacy Protection Act (COPPA).

7.2 No Collection of Personal Information

We do not knowingly collect, use, or disclose personal information from children under 13 without verifiable parental consent. The App stores data locally and does not transmit personal information to external parties.

7.3 Parental Rights

Parents and legal guardians have the right to:

• Review any personal information collected from their child
• Request deletion of their child's personal information
• Refuse to permit further collection or use of their child's information

7.4 Parental Oversight

We encourage parents and guardians to monitor their children's use of the App and to help ensure compliance with these Terms.

8. Prohibited Uses

You agree not to use the App to:

• Violate any applicable laws or regulations
• Create, upload, or share inappropriate, offensive, or harmful content
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Interfere with or disrupt the App's functionality
• Attempt to gain unauthorized access to any part of the App

• Collect or harvest information about other users
• Use the App for any commercial purpose without authorization

9. Disclaimers

9.1 "AS IS" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Warranty

WE DO NOT WARRANT THAT:

• The App will meet your requirements
• The App will be uninterrupted, timely, secure, or error-free
• Any errors in the App will be corrected
• The App will be free from viruses or harmful components

9.3 Use at Your Own Risk

Your use of the App is at your sole risk. We are not responsible for any damage to your device, loss of data, or other harm resulting from your use of the App.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of your data
• Any bugs, viruses, or harmful code transmitted through the App
• Any errors or omissions in any content
• Any conduct or content of third parties using the App

11. Indemnification

You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your use of the App
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another party

12. Third-Party Links and Content

The App may contain links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

13. Modifications to the App

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

14. Termination

14.1 Termination by You

You may stop using the App at any time by uninstalling it from your device.

14.2 Termination by Us

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

14.3 Effect of Termination

Upon termination:

• Your right to use the App will immediately cease
• You must delete the App from your device
• Provisions that by their nature should survive termination shall survive

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising out of or relating to these Terms or the App shall be resolved through appropriate legal channels.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and supersede all prior agreements and understandings.

18. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

19. Assignment

You may not assign or transfer these Terms or your rights under these Terms, in whole or in part, without our prior written consent. We may assign these Terms at any time without notice.
